Terms of Service

These Terms of Service ("Terms") govern your use of the Tonight app and website ("Tonight," the "Service"). By creating an account, joining the waitlist, or using the Service, you agree to these Terms. If you don't agree, please don't use the Service.
1. Who can use Tonight
You must be at least 13 years old (or the minimum age required in your country) to use the Service, and you must be able to form a binding contract. If you use Tonight on behalf of a household, you're responsible for the activity of those members.
2. What Tonight does
Tonight is an AI-powered meal planning assistant. It suggests meals, provides recipes and nutrition information from third-party recipe providers, builds grocery lists, and can generate a pre-filled Instacart cart. Recipe content, nutrition figures, and availability come from third parties and may not always be accurate or complete.
3. Your account
You're responsible for keeping your login credentials secure and for all activity under your account. Let us know promptly if you suspect unauthorized use. Authentication is handled by our provider, Clerk.
4. Subscriptions and billing
- Tonight offers an auto-renewing subscription ("Tonight Pro"), including a free trial where offered. Pricing is shown in the app before purchase.
- Purchases are processed by Apple through your App Store account and are subject to Apple's terms. Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period.
- You can manage or cancel your subscription anytime in your Apple ID / App Store settings. Except where required by law, payments are non-refundable; refund requests are handled by Apple.
5. Acceptable use
You agree not to misuse the Service, including by attempting to disrupt it, reverse-engineer it, access it through unauthorized means, or use it for any unlawful purpose.
6. Third-party services
The Service integrates third-party providers (including Anthropic, Edamam, Spoonacular, Instacart, ElevenLabs, RevenueCat, and Apple). Your use of features powered by them may also be subject to their terms, and we are not responsible for third-party products, availability, pricing, or fulfillment (for example, grocery orders placed through Instacart).
7. Intellectual property
Tonight and its branding, design, and software are owned by us and protected by law. We grant you a limited, personal, non-transferable license to use the Service for your own household use. Recipe content remains the property of its respective providers.
8. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, to the fullest extent permitted by law. We do not guarantee that meal suggestions, recipes, nutrition data, or availability will be accurate, complete, or suitable for your needs.
9. Limitation of liability
To the fullest extent permitted by law, Tonight and its team will not be liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us in the twelve months before the claim.
10. Termination
You may stop using Tonight and delete your account at any time. We may suspend or terminate access if you violate these Terms or misuse the Service.
11. Changes to these Terms
We may update these Terms from time to time. We'll post the updated version here with a new "Last updated" date, and continued use of the Service means you accept the changes.
